CinOS is operated by Cin Coast Realty ("we", "us"). Before you use CinOS, and again whenever this acknowledgment changes, you confirm the statements below and sign them with your typed name. Every user signs for themselves: the account owner, admins and every agent on a team. This acknowledgment is in addition to our Terms of Service, which still apply in full.
What this covers
"Material" means anything you upload, import, attach, paste or publish through CinOS, including photos, videos, virtual tours, floor plans, documents, logos, graphics, artwork, text, music and audio. It includes material you import from services you connect, such as Dropbox, Google or an MLS or other data feed, and material you publish on listing pages, landing pages, property search pages, emails, video messages, client portals and the OCLA network.
What you confirm
By signing, you confirm and agree that:
- You have the rights. You own every item of material you upload, import or publish through CinOS, or you have written permission or a written license from its owner that allows you to use it the way you use it on CinOS, including publishing it where you publish it.
- MLS and data-feed media. You use photos, descriptions and other media provided by a multiple listing service (MLS) or another data provider only as that provider's rules and license allow, for example only for the listings, purposes and period they permit, and you remove it when those rules require.
- People and property. You have any permission the law requires to show the people and private property that appear in your material, and to use anyone else's name, likeness, logo or trademark in it.
- You are personally responsible. You are personally responsible for all material you upload, import or publish, including material you upload for your team, your brokerage or a client. Using CinOS for someone else does not make us responsible for your material.
- Indemnity. You will defend, indemnify and hold harmless Cin Coast Realty and CinOS, and their owners, employees and contractors, against any claim, demand, loss, damage, penalty or cost, including reasonable legal fees, arising from material you upload, import or publish, or from your breach of this acknowledgment.
- Removal on request. If we ask you to remove material, for example because we received a copyright notice, a rights holder complained, or an MLS or data provider withdrew permission, you will remove it promptly. You also agree that we may remove or disable it ourselves.
- Consequences. Breaking this acknowledgment can lead to removal of material and to suspension or termination of your access or your account, including under the repeat infringer policy in our Copyright Policy.
How we keep your signature
When you sign, we record the name you type, the date and time (from our server), your IP address, your browser's user agent, the version of this acknowledgment and a fingerprint (hash) of the exact text you were shown. We keep that record as described in our Privacy Policy. If we change this acknowledgment in a way that matters, we will ask you to read and sign the new version before you continue using CinOS.
Copyright complaints
If you believe material on CinOS infringes your copyright, see our Copyright Policy. This acknowledgment does not change how we handle copyright notices.
